i look at it like this, its kinda plain and simple to all the debating you guys are having about it though. when i'm driving at night, would it be ok to have bill boards with motion lights that shined super duper bright at my car to get my attention to look up at it? Loud lights if you will...

Would it be OK then for the government to step in? or should i just learn to deal cuz we're free to do what we want? i don't have to look up do i? they have freedom of speech right? i only bring this up and use it as a comparison because its already happening where i live! not motion lights but lights soooo effin bright that my retina's have image retention from it and i cant see shit for minutes after.

i'm tired of watching sporting events at a higher volume with my surround sound that is still comfortable and not disturbing, only to have the volume increase by 50% when a commercial comes on. living in apts that really pisses my neighbors off and they start hitting their celling which is my floor. plus it makes my head feel like its going to implode!

i hope they nail um up for this because it really is disturbing my domestic tranquility!

Not to bump this thread, but I don't see the comparisons as being the same. First, overbright lights on a billboard are a public safey hazzard. Second, it's not the issue of regulating the volume that I have issue with (even though I don't think it's possible to enforce such a regulation) - it's whether the federal government should be the body doing the regulating. That's really what I have issue with. Whether they have the authority or not (and I've conceded the point that this will stand in the courts) it's a silly thing for Congress to waste time on - especially since they attacked this issue, thereby letting other (real) issues languish. This is really more important than passing a budget? This is not a matter of pressing national interest. It's a local issue that should be handled by local authorities. Not by Congress. It's a waste of their time and my tax dollars. The Constitution does not protect us against life's annoyances. I really wouldn't want it to mean that - nor would (I would gather) most Americans.

I've tried to stay out of this, but here I go again...

Congress has mandated that the FCC regulate the volume. The FCC is a US government agency already regulating the stuff going on the air.

The FCC already has a policy in place that says the peak levels of commercials can't exceed the peak levels of programming. So to an extent they are already regulating how loud a commercial can be. The problem is, a 30 commercial can be as loud as a 4 second explosion.

What's more, if you're watching a relatively low-level show (say something about the Salem witch trials on the History Channel) and then it cuts to a commercial, an already loud commercial will seem even louder.

Congress already put the FCC in place to regulate communications. All they are requiring them to do is their job. If it's unconstitutional for the Federal government to censor content, to decide what words can't be spoken or what body parts can't seen, then why aren't you up in arms about the FCC in general? But if you don't have a problem with those issues, then I don't see what they big leap here is to say the government can't dictate how annoyingly loud your commercial can be. There's no difference.

Was this the most pressing matter for Congress lately? No. Could this have waited til they decided on extending the tax cuts? Yeah. Have they torn up the Constitution and taken a big dump on states' rights? No. I will point out though that Congress has been looking at this since mid-2008, you know, before they passed the stimulus. And they still found time to pass ObamaCare. It isn't like this bill is anything new, or getting in the way of bigger issues. The real reason why they haven't voted on the tax cuts, budgets, etc. is because it's an election year. Not because of this bill.

This isn't a local issue anymore than censoring pornography is. The FCC is not a local government agency with different rules for New York, Maryland, and Wyoming. The FCC makes blanket decisions that affect the whole county all the time. And since many commercials are broadcast over the entire country, ity makes sense to have one standard regulated by an agency already in place to do just that. Not make 50 different states make 50 different rules up. That would be silly.

And for all the hollering about how many more important issues there are, it's ironic that this one is getting the most attention from you guys.
