And the news just keeps getting better for Dish. They lost the lawsuit that Tivo filed against them. Looks like D* may be getting a flood of new customers looking for a DVR.

Actually Dish and Directv DID try to merge a few years ago and the big cable companies lobbied in DC against it ..you could say that cable tv bought congress votes by pampering them with gifts if they did'nt vote for it.
The deal did not go through for the merger.

The XM/Sirrius merger is much different from the Dish/Echostar merger from a market perspective.

No. Its not different. XM/Sirius was more difficult, so they could try the Dish/DTV again.

Sat TV has more competition. With XM/SIRI successfully claiming HD radio and internet radio was competition, it opens the door to claim OTA TV, Cable, and C-Band are competition.

Not saying it would happen, but IMO, XM/SIRI may have changed things if they choose to try it again.

Correction, NOT yet approved. You have confused one Depts. approval as the FINAL approval.

It was NOT approved. It is up to the FCC to approve the merger. The Department of Justice (DOJ) gave it's approval saying that they deemed "that an XM-Sirius merger was not anti-competitive". Basically, they said it was not forming a monopoly and consumers would still have options (in the opinion of the DOJ) and the DOJ would not pursue anti-trust charges if they did in fact merge.

It is, and has been, up to the FCC, who regulates them, to approve the merger. That decision has not been delivered yet.

....and the FCC has NEVER gone against a DOJ decision. This will be approved in a few months.
