There are flags in the data stream that tell the HDMI receiver whether Deep Color is being used. From the HDMI receiver's point of view, any color data field more than 8-bits is Deep Color. The receiver doesn't care if the extra bits are real data, or if they are interpolated up from 8-bit data or if they are all zero--as far as the receiver knows, it's a Deep Color signal.
