A flyer (E696 1208 X49752) that was enclosed with my latest bill from Comcast surprised me. I usually don't read these inserts but this time I did. Under a section called "Customer Equipment-Limitations of Comcast's Liabity" it says the following:
Customer equipment may be damaged or suffer service outages as a result of the intallation, self-installation, use, inspection, maintenance, updating, repair, and removal of Comcast equipment, customer equipment and/or the services. Except for gross negligence or willful misconduct, neither Comcast nor any of its affiliates, suppliers, employees, agents, or contractors shall have any liability whatsoever for any damage, loss, or destruction to the customer equipment. In the event of gross negligence or willful misconduct by Comcast, its suppliers, employees, agents or contractors, we shall pay for the repair or replacement of the damaged customer equipment (at our sole discretion) up to a maxium of $500. This shall be your sole and exclusive remedy relating to such activity." After reading that, I'm afraid to let any of their techs in my home anywhere near my computers or expensive plasma TV that cost well over $500. Lastly; how does one even prove to their satisfaction that the tech was incompetent or just evil? When you complain about poor service they don't want to hear it or they remind you of all the good charitable work they do in the community. I think this is the worst form of customer bashing I've ever seen. |

That's pretty standard practice for any company where you're forcing them to interact with your equipment. I had a workman in to install a fan in my dryer exhaust vent. Guess what.. the same type of exculpatory clause can be found in the contract. If they broke my clothes dryer, and it wasn't "gross negligence or willful misconduct", then the fix to the clothes dryer would be on my back.

How people have/tried to say that the cable box messed up thier tv? or that the modem crashed thier computer?
